What is Probate?
Probate is the process of using the court system to pass a deceased person's property to his or her heirs, finalize payments to creditors, and create any necessary testamentary trusts. In other words, it is the process of administering a decedent's estate. Once the process begins, a personal representative or executor will be appointed and will undertake the tasks of gathering all of the deceased person's property, notifying potential creditors, and finding the heirs or beneficiaries.
In Oregon, personal representatives are generally required to hire an attorney to advise them on their fiduciary duties to the estate. If you believe the probate process will be necessary to transfer property to heirs or beneficiaries of Wills and Trusts, you should contact a probate attorney immediately to start the process. If you wait too long, one of the decedent's creditors may be appointed as the personal representative. Not only are fees for a personal representative provided for in Oregon law, but those administration fees may be awarded to a creditor in addition to the creditor's own claims against the estate.
If you receive a notice regarding the probate of one of your relatives, you should contact my office immediately since deadlines to respond may be short in probate proceedings.
